How North Carolina Defines Drug Trafficking

Under N.C. Gen. Stat. § 90-95(h), trafficking may be charged based on the weight of a controlled substance involved in its sale, manufacture, delivery, transportation, or possession. Once the applicable weight threshold is met, the prosecution doesn’t have to prove that the accused person intended to sell or distribute the substance.

The entire weight of a mixture containing a controlled substance generally counts, regardless of purity. As a result, the collection, identification, and weighing of the alleged substance can become important issues. These charges are felonies, and cases arising in Rowan County are heard in Rowan County Superior Court.

North Carolina Drug Trafficking Weight Thresholds

North Carolina law assigns felony classes, mandatory prison terms, and minimum fines according to the substance and alleged weight. These state-law tiers don’t include the separate penalties that may apply in a federal prosecution.

Key trafficking thresholds and penalties include:

  • Shared $50,000 minimum fine: This amount applies to 2,000 to 10,000 pounds of marijuana, 28 to 200 grams of cocaine, 28 to 200 grams of methamphetamine, and four to 14 grams of covered opioid substances other than heroin.
  • Marijuana: Ten to 50 pounds: Class H felony, 25 to 39 months, and a minimum fine of $5,000. Fifty to 2,000 pounds: Class G felony, 35 to 51 months, and a $25,000 minimum. Two thousand to 10,000 pounds: Class F felony and 70 to 93 months. Ten thousand pounds or more: Class D felony, 175 to 222 months, and a $200,000 minimum.
  • Cocaine: Twenty-eight to 200 grams: Class G felony and 35 to 51 months. Two hundred to 400 grams: Class F felony, a 70-month minimum and 93-month maximum, and a $100,000 minimum fine. Four hundred grams or more: Class D felony, 175 to 222 months, and a $250,000 minimum.
  • Methamphetamine: Twenty-eight to 200 grams: Class F felony with a term between 70 and 93 months. Two hundred to 400 grams: Class E felony, 90 to 120 months, and a $100,000 minimum fine. Four hundred grams or more: Class C felony, 225 to 282 months, and a $250,000 minimum.
  • Heroin, opium, and covered opioid substances: Four to 14 grams: Class F felony with a term from 70 through 93 months. The stated minimum fine for heroin is $500,000. Fourteen to 28 grams: Class E felony and 90 to 120 months. Twenty-eight grams or more: Class C felony, 225 to 282 months, with a stated minimum fine of $1 million for heroin.

A trafficking conviction generally can’t result in probation or a suspended sentence. The court ordinarily must impose the mandatory minimum prison term for the applicable substance and weight tier unless a statutory exception applies.
