What Are the Steps Involved in Administering an Estate?

Each estate follows its own path depending on the assets involved, family dynamics, and any disputes that arise. Estate administration generally includes the following steps: 

1. Opening the estate. The personal representative must file the necessary paperwork to begin probate and receive authority to act on behalf of the estate.
2. Taking inventory. You must locate, value, and report all of the deceased person’s probate assets to the Clerk of Court within 90 days.
3. Notifying creditors. We can assist with publishing a formal legal notice to creditors in a local newspaper and mailing notices to known lenders.
4. Paying valid debts. After the 90-day creditor claim period expires, we can help you evaluate and pay valid debts in the priority order required by law.
5. Distributing assets. Once all debts and taxes are settled, the remaining property and funds can be distributed to the rightful beneficiaries. 
6. Closing the estate. We assist with preparing and filing the final accounting with the court so the judge can officially close the case.

Do All Estates Have to Go Through Probate in North Carolina?

Not every estate requires a formal probate proceeding. North Carolina offers simplified administrative options for smaller estates. For example, if the deceased person's personal property is valued at $20,000 or less (or $30,000 if the surviving spouse is the sole heir), you may qualify to use a Small Estate Affidavit. 

This streamlined process allows you to collect and distribute personal property more efficiently while bypassing the court oversight of traditional probate. Additionally, certain types of assets can bypass probate entirely, regardless of the estate’s total value.

• Duty of prudent administration. You must settle the estate as efficiently as reasonably possible without sacrificing the value of the assets. Unnecessary delays that cost the estate money may be considered a breach of fiduciary duty. 
• Duty to account. You must maintain transparent financial records of every penny that enters or leaves the estate and provide accurate accountings to the Clerk of Superior Court and the beneficiaries. 

How Long Does Estate Administration Take?

State law requires the estate to remain open for at least 90 days just to give creditors time to submit their claims after the initial public notice is published. A standard probate case generally takes 6–12 months to complete.

However, administering an estate can take longer if it involves selling real estate, dealing with complex federal taxes, or resolving beneficiary disputes. A simple clerical mistake on the 90-day inventory can also cause the court clerk to reject your filings, resulting in frustrating delays.
